After all the talk about copyright responsibilities faced by part 15ers for transmitting and streaming music, the Triton Digital conversation heard on LPH # 102 brings to our attention several facts that have not been mentioned by anyone (that I've heard or read).
While the category of "hobby broadcaster" continues to be used in our own discussions, the experts never once mention "hobby broadcaster." I doubt that there is such a legal category when it comes to royalty rules.
But they did mention "small streamers," which sounds a bit derogatory, and mentioned that the special simple rate ($500 a year with no reporting requirement) has been withdrawn, meaning that small streamers won't be physically able to go on as one man operations.
However if you kept listening, they eventually mentioned "non-commercial streamers," and I think that's a euphemism for "hobby broadcaster."
So forget "hobby" and call yourself "non commercial," and then you'll get the $500 annual no-reporting rate. Are we good?
One other thing.. that stupid petty thing about only two cuts from an album in a 3-hour period.. well what about classical music? If you play a symphony you play 4-cuts in a row and usually that means playing the whole album! How is that supposed to work?
Oh, oh, oh, and has anyone mentioned using just a dab of copyrighted material in a weeks time on an all talk station? That should be a category. Why isn't it a category?
No wonder military equipment is the biggest industry of all time... you get upset and need heavy artillery.

The reporting requirement is fatally flawed by the fact that streamers have NO idea whether "connections" to their webstreams are actually listeners.
The server windows show IP numbers as connections come and go, but they could be all kinds of things: hackers looking for vulnerabilities, NASA snooping on a station's political speech, royalty police bounty hunting for non-payers, or...
IP stream connections could be counterfeit listeners deliberately generated by the copyright trolls to generate extra income!
Even actual listeners don't always listen while they're connected. Some of them fall asleep or get into telephone conversations or talk with other family members, hearing little of what's being sent on the stream.
I'll stop writing as soon as I figure out a way to weave the word "racket" into this editorial comment.

I started to create another account with a major streaming server and backed out. There is just no way I can justify throwing money away while not making a penny of it back via revenue.

Do any of our long time members remember Rock 103 FM?They are asking for donations to remain on the air (online), streaming royalties increased and they are one of the many part 15/internet stations that will be hit hard next year. Rock 103 does a wonderful job of running a professional sounding station, no i am not trying to drum up donations for them just wanted to drop in and share this. I think we will see more and more part 15 stations that stream pop up with either donation drives or just closing out their streams. It's not looking good. There have been people asking if I have a stream version of BBR and I have said point blank, will you be paying for said stream? I usually get a laugh like something is funny. I never got the punchline.
