Some Unusual Things In This Pirate StoryDavina Elena Mendes was found to be operating illegally with an over-powered signal at 87.7 FM in Dorchester, Massachusetts. The unusual things noticed in this story are that 87.7 is not mentioned as an unauthorized frequency, and the allowable power stated by the Boston FCC office is 100 uV meter/at 3 meters, which does not match the 250 microvolts per meter/3 meters stated in 15.239. I believe that for the frequency ranges 30-88 Mhz, the Part 15 limit is actually 100uv/m at 3 meters (I took that from an amateur radio site, and it should be in a table somewhere in the Part 15 regulations.

Part 15.209 specifies operation between 30 and 88 mHz shall not exceed 100 uV/mtr except as defined in paragraph g.;
(g) Perimeter protection systems may operate in the 54-72 MHz and 76-88 MHz bands under the provisions of this section. The use of such perimeter protection systems is limited to industrial, business and commercial applications.
Perhaps this is where the agent came up with the 100 uV/mtr spec. Of course paragraph g does not specify what the emission limits are for those specific applications.

And further, "*Except as provided in paragraph (g), fundamental emissions from intentional radiators operating under this section shall not be located in the frequency bands 54-72 MHz, 76-88 MHz, 174-216 MHz or 470-806 MHz." which means unless your device is a perimeter protection system, stay out.

So 87.7 isn't illegal in the US just less than half the allowed signal strength as the 88-108MHZ band. 100uV/M@3Meters....not enough to get you out of the house. But OK to get you across a large room to a stereo with no interference from any stations.

Well, it's not illegal if you are operating a perimeter protection (i.e., security) system that uses that frequency and has a field strength of maximum 100uv/m at 3 meters. Other uses (such as broadcasting) are illegal.

Bits and PiecesHere and there in the FCC rules new sections get added from time to time. Sub-Part H: Part 15.701 - 15.717 is recent, and defines several frequency bands open to "white space devices", including wireless microphones. Frequency band 76 - 88 MHz is Included in 15.707b

I think Carl got it! Only a two way communication from one person to another and only 100uV/M @ 3 meters which will get you to the next room. This must have been a revision when TV vacated. But even the agents sometimes don't know their stuff as Michael at Decade once told me.

And you know this might explain how the transmitters like the scotch can be sold at Walmart.
I still have my predictions for the future of 87.7 could become more legal than a gray area.
You also have to remember that place is like Dorchester Massachusetts are too close to the problem bed of New York and New Jersey that's why they wanted to make an example out of that woman.

Right, I've seen Dollar Store transmitters that go to 87.9 and 87.7, lots of them seem to, and sometimes those are the only frequencies open.
